THIS IS A NOTICE OF INTENT TO AWARD A SOLE SOURCE CONTRACT AND IS NOT A REQUEST FOR COMPETITIVE QUOTES Naval Supply Systems Command (NAVSUP) Fleet Logistics Center San Diego (FLCSD) intends to award a firm fixed price (FFP) contract to EDAX, LLC 5794 W Las Positas BLVD, Pleasanton California 94588-4083, United States. Under the authority of FAR 13.106 (1) only one responsible source and no other supplies or services will satisfy agency requirements. The requirement is for maintenance of two detectors: an energy dispersive spectrometer (EDS) and an electron backscatter diffractometer (EBSD). Both were manufactured by EDAX, LLC. A qualified service engineer will respond to calls from the NPS technical POC within one business day over the twelve-month period. The service engineer will diagnosis problems with the instrument that may arise during normal operations either over the telephone or in person, as necessary. Annual preventive maintenance will be performed including inspection of the equipment and calibration for optimum performance. Maintenance support should include support for the control PC and other support hardware and software (including EDAX TEAM) furnished by EDAX. The EDS, EBSD detectors, and supporting hardware and software are manufactured by companies such as Bruker, Oxford Instruments, and EDAX. The instruments, however, are not compatible with each other in terms of hardware and software. The EDAX detectors are proprietary, this is both the instruments themselves as well as the communications boards that go into the support computer and the software used to control the detectors. A qualified EDAX technician is required to install software updates and to perform the calibrations required during annual servicing of the detectors. Technicians from Bruker and Oxford, though proficient, would not have the adequate experience with EDAX hardware and software to complete the necessary calibrations. No other vendor other than EDAX is capable of fulfilling this requirement in a manner that would ensure operational functions. The purchase of inadequate service would risk research and damage to the existing equipment which directly supports student and staff development. The purchase order will be paid for via the Wide Area Workflow (WAWF). Personnel cannot cancel or discontinue services until directed by the Government. The anticipated award date of this action is on or before 1 August 2026. The applicable North American Industry Classification System (NAICS) code is 811210 – Electronic and Precision Equipment Repair and Maintenance. This notice of intent is not a request for competitive proposals and no solicitation document exists for the requirement. Sources interested in responding to this notice are required to submit a capability statement that includes management and technical data and cost information, in sufficient detail and with convincing evidence that clearly demonstrates the capability to provide the licenses and proof as being an authorized vendor of these services. Capability statements shall not exceed 6 (8.5 x 11 inch) pages using a font size no smaller than 10-point. All capability statements received by the due date of this notice will be considered by the Government. A request for documentation or additional information or submissions that only ask questions will not be considered as an affirmative response. A determination by the Government not to compete based on responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement or to proceed with a sole source purchase order.
